I left FL with my 6 month old baby almost 6 months ago to live in AL with my now husband. After I left my ex boyfriend (the father of the baby) filed to start custody in FL. I have responded to all of the motions and am complying with and attending the court hearings by telephone. My ex is now stating that there will be a pickup order for the baby because I am in AL. He is not on the birth certificate, we were never married, although when I was residing in FL i had initiated child support and DNA was done confirming he was the father but I ended up not going any further with the child support in FL because I moved. I am not trying to keep him from his son however although he has asked to see him I am very reluctant to just hand him the baby without some agreement entered into the courts in fear I wont get my son back. MY MAIN CONCERN IS THERE GROUNDS FOR THE COURT TO ISSUE A PICKUP ORDER AND IF SO WHAT CAN I DO TO PREVENT THAT FROM HAPPENING?
Yes there are grounds. He filed for paternity and custody while Florida still had jurisdiction over your son. As a result, you need to file a petition for relocation and do it IMMEDIATELY. You really should be hiring a lawyer to assist you with this. Even though he had no rights prior to filing, once he gets a paternity order, he will have the same rights that you have, and with Florida having jurisdiction over the child, he could force the child's return.
This also obtains elements of foreclosure law and issues regarding conflict of interest.
Yes, there are grounds for the entry of a pickup order. You should consult with an experienced family law attorney in further detail.
