Is there any way to get jewelry back from my husband ? I have files for divorce in Illinois. it is in trial. it is my wedding jewelry gifted by my parents. He is claiming that he returned but he did not.
in almost every case involving parties from india, there is a claim by the wife that she has or had gold jewelry and no longer has it and the husband denies that he ever had it. it is almost im/possible to prove that the gold existed and that wife at one tim/e had it or wore it. given this conflicting testimony, usually the judges say that there is nothing they can do about jewelry.
no one does this but the best way is for the wife who receives the jewelry to make a list of what there is and have the husband or his parents sign that this was a gift to her. i doubt that they will sign such a list nor that the wife will make one.
this is a common and frustrating issue. there is no good solution.
