I filed for divorce. My wife responded by filling an injunction for domestic abuse. She did so by making up a charge (saying i hit her) and filling a false police report. She blatantly lied about key facts in the report... Which we can prove.
I also have an attorney already. We had the hearing today, and filed a continuance because we needed some additional documentation (911 audio and subpoenaing the police officer who filed the report) ironically both which back my story. My wife's claims are essentially even contradicting the police who were here.
Anyway, to my question. My mother in law seems to see a continuance filing as a conviction. She is mailing my family and friends telling them i beat my wife, and kidnapped my son. Can i stop these people from defaming me?
You claim that you have hired an attorney, you should pose this question to him/her.
No attorney-client relationship exists by virtue of any AVVO Q&A with Keith Petrochko. Anything posted on AVVO, or anywhere online, may be used as a statement against your interest in a subsequent legal proceeding.
I agree, if you have already hired an attorney then you are going to find a reluctance on the part of other attorneys to answer any questions. It's best to get your attorneys opinion first and then go from there.
A continuance is not any type of conviction and your attorney filed it for a good reason. You also hired an attorney for a good reason so I would follow his or her advice.
