So we have two undocumented parents, mother was deported 7 years ago and has not entered the US again, father is in the US with three US children, one of us is 20 yrs old, other is 17 and one that is 7.
Is there any hope for the 20 year old to petition any parent? We know there is a 10 year bar for our mother, probably same for father, we see there is a Provisional Unlawful Presence Waiver, however it seems that only people who can get this waiver are those with a USC or LPR spouse or parent? Which our parents have neither of those only USC children.
Anything we could do?
Any advice would be helpful,
You must be 21 to petition for your parents.
Your mother needs to wait 3 more years before she can get an immigrant visa and return to the US.
Your father? He doesn't appear eligible for a provisional waiver ... until after his wife (your mother) gets her greencard.
Work with a lawyer.
