I am currently going through a divorce. We are awaiting our court date after having filed. We just sold a house. It's an uncontested divorce, I am the respondent. My real estate agent mentioned having something written up for her to sign so that she gives up her right to any property I make an offer on now, that may close prior to the divorce being final.

If you attempt to purchase a home while a divorce is pending, the mortgage company or title company will probably ask that she sign a Quit Claim Deed to the house so that they can award the property to you as your separate property. I don't think you can get any type of universal release from her that a title company will accept, it will have to be a Quit Claim Deed on the house you want to buy. The other option will be to wait until the Decree is entered. If this is uncontested, that can be a soon as 90 days.
You should consult with a family law attorney to ensure that the many details are addressed. A quit claim deed would be what you are referring to but it is not a guarantee and the title company has to accept it.
