Divorce final Aug. 2004. Order included clause regarding percentage of former spouse's inheritance derived from sale of mother's house and property in accordance with her will to be paid to me. Property still hasn't been sold. Can I collect a settlement?
This isn't really a statute of limitations question. The property division is closed, meaning that you can no longer re-argue the actual terms of the settlement.
You may, however, be able to sue for enforcement by filing a Rule to Show Cause in Family Court.
I would consult with an attorney to review the settlement order, and decide how to proceed. You can obtain a referral from the Delaware State Bar Association's Lawyer Referral Service.
