is there a statue of limitations on prisecuting on a third degree felony for driving on suspended license habitual offender
yes there is and I believe pusuant to 775.15 it is three years but there may be circumstances that will lenghten that by one year.
Under Section 775.15(2)(b), Florida Statutes, the limitations period for a third degree felony, including a third or subsequent charge of driving with a suspended license, is three years from the date the offense is committed. This means that the formal charge must be filed before the third anniversary of the offense. Because this is a felony, the formal charge must be in the form of an information (or indictment) filed by the State Attorney for the circuit where the offense occurred; a uniform traffic citation is not enough. Generally, it does not matter how long it takes for the State to actively prosecute the person who is wanted for the felony; for example, if the offense is committed on January 1, 2011, and the defendant is arrested and released, as long as the formal charge is filed by January 1, 2014, even if the defendant remains at large, the defendant can still be prosecuted for the offense years later long after the limitations period has expired. If a formal charge is not filed within three years but the defendant is continuously outside the State of Florida, the limitations period can be extended an additional three years. If the defendant is never arrested (which is unlikely in a suspended drivers license case) and the information is timely filed, the State is obligated to serve the warrant on the defendant without unreasonable delay unless the defendant has left the State of Florida. It is extremely rare that the statute of limitations bars a prosecution; the State Attorney always keeps the statute of limitations in mind, and if the State does mess up, the State won't draw attention to its error by filing an overdue charge. Note that there is no statute of limitations for capital felonies, life felonies, or felonies that result in a death.
