My daughters father has been arrested and is in county jail for probation violation due to non payment of his child support order. I had been told my a friend that if you are put in jail over child support they cant hold you over 90 days. Is this true?
It would largely depend on what the jail time is actually for. If it is based on a criminal charge for Non-Support of a Dependent Child, there would be a range of sentencing, if found guilty that could go well beyond the 90 days you are indicating. If the court has found him in contempt of a court order for support, he could be held up to 180 day. If it is for a violation of probation, he could be ordered to serve the balance of the suspended sentence on his case. There are too many variables to give a solid answer to your question.
