Where is the father in this legal picture? He is a necessary party. The mother is one-half of the necessary parties, the parents. If both parents consent your case is strong if there is nothing bad to concern the court regarding you or your home for the children. You need family law counsel in El Paso County to file either an original suit regarding the children or a modification of any prior court order. You need waiver and consent by Mom and service or waiver and consent by dad. If any other parties have an interest, i.e. OAG, etc. they will need notice.
