I have searched the County website, but do not find a form for filing a Counterclaim with my Answer. If there is a form available, could you provide me with a link for it?
Also, is there a form for Additional Affirmative Defenses? I can't seem to find that either.
There is no form. Also, if you seriously believe that you have defenses or counterclaims, consult an attorney. It should not cost you anything to consult one (at least that is our practice).
As Mr. Edelman said, there is no form for answers, counterclaims, or complaints. The gist is that you draft these based upon the applicable elements you must prove.
If you are trying to DIY, I would suggest consulting an IICLE handbook on the area of law you are involved in and it will have plenty of basic guidance and some forms.
There are not any forms. A counterclaim ( which is drafted much like a complaint) is included as part of the answer to the complaint. As to the affirmative defenses, there is no form there either. Defenses which must be alleged in the Answer to the complaint or waived are set forth in the rules. A law library will have examples on how to plead them.
I agree there are no such forms. Your best bet is to use the format of the complaint itself, just changing the title to counterclaim or affirmative defense. The two most important parts are having a caption with the name and number of the case, and numbered paragraphs.
