I had to have several MRI and get physical therapy, I slipped on a wet floor that evidently the clerk was mopping and their were no signs up.She is denying it. All evidence is on a survelliance tape, that I was unsuccefully able to get. My medical bills and co-payments are expensive, and I may have to go bankrupt. Any information would be helpful.

Hire a personal injury lawyer in your area immediately. Sovereign imunity is not a complete bar to a tort claim in Virginia. There are options available to you and a lawyer can sort out the facts and figure out a way to pursue a claim. There are strict time limits, so do not delay.

There are several ways around sovereign immunity and as the previous attorney correctly stated, it will come down to the degree of care and the amount of control the store owner exercised over the property.

In the Commonwealth of Virginia, when the State engages in what would be considered a regular business activity, such as operating a store front, they are not completely protected by Sovereign Immunity. However, there maybe limitations on the amounts you can recover. In addition, many of the ABC stores in Virginia have been privatized although they maintain the letterhead of an ABC store, in this case there would be no protection at all under Sovereign Immunity.
