I received a speeding ticket on the I86 doing 91 mph on a 65 mpz and I heard that Bath town court only has a district attorney who makes all the decisions on whether your eligible for the point reduction program but I also heard he goes by your driving record and not the actual ticket on hand - I also heard I won't qualify because I have a driving while impaired on my record from 3 years ago. Is this true ?

Steuben County has a program which allows most drivers to complete an online program in order to gain a reduction on a traffic infraction. This program requires a fee be paid. It is usually a couple hundred dollars. This normally requires a not guilty plea to be entered prior to the ticket coming before a court. The program is offered as a way to reduce the traffic offense. I believe that in order to be allowed to take the class you cannot have a driving offense in the jurisdiction in the past twelve (12) months. I am not aware of a DWAI being an absolutely bar to being offered the online program.
