I have a training contract with an airline based in WY. The contract was for 15 months (started 1/15/16) and states in ch.2 "...or is discharged at any time during training or within 15 months of active service... he will repay..." and then in ch.5 says "The 15 month active service ... shall include any periods of involuntary furluogh... The 15 month active service shall not include any periods of medical leave...". I took a personal leave approved by the company and they are saying that falls into not being active. However, chapter 5 only mentions medical leave. What are my options?
I'm sorry to hear about your situation. It is frustrating when you feel like you're getting jerked around. I cannot tell from your question alone, what your options are. I encourage you to contact an attorney who can review the contract you have and advise you of your rights and how best to protect them and your peace of mind.
A Wyoming attorney is likely going to need to review this contract in full to provide a meaningful answer. What you appear to be asking is whether the "leave" you were granted waived some provisions of your training agreement.
The foregoing is neither legal advice nor is it in any manner whatsoever meant to create or impute an attorney/client relationship.
