I was the primary resident of an apartment where my mother and ex boyfriend were coresidents. Due to circumstances, we all had to move out and find a replacement. The replacement had agreed to be the sole resident living in the apartment by himself for the rest of the lease (we were all still on the lease contract). However, when the replacement moved in the first week, he complained of roaches. I had not seen roaches, but was later informed the small black bugs I had seen maybe 3-4 of within the past several months were small roaches. The apartment hired an exterminator within 3 days. However, as the extermination was not quick enough for him, the new roommate decided he no longer wanted to live there. He had already signed the leasing contract (the same as my mother, ex, and I had signed). Therefore, we all broke the lease contract early as no one wanted to live there/pay. The apartment sent a debt to the collections agency, but their letter only stated that I, my mother, and my ex owed the money. It did not include the new roommate who had caused all the issues. Did he get out of the lease agreement, or is it possible that the collections agency is going after him separately?
Leases are joint and severable liability so they can go after the easiest target. They can ignore him and then you would have a case against him for his share.
