I have a debt that is only in my bane and they might sue me. If they get a judgment can they put lien on house if I am not on the deed but only deed of trust. Deed has my husbands name and a married man beside it. We were married when my husband bought the house. I am not on the mortgage at all.
Tenancy by the entities required both married parties to be on the deed. As you are not on the deed, the judgment against you cannot attach to the home. Being on the mortgage or not is irrelevant...its who is on the deed. If you were on the deed, TbE would protect the home also.
