I was denied edd benefits because my work has me in a active statis, while social services takes up to 75 days to give an exception as a caregiver with the caregiver act that was emplimented 1/162016 you have to be licensed. Because you have to available for work to qualify I was denied! That makes me unavailable! But not to find other work as a medical asst I have a diploma for so I am able to find work, it's not true!
If you were denied unemployment benefits, you have appeal rights. The written decision (Form DE 1080) has appeal procedure on it. Look for the deadline to appeal, normally 20 days from the date of mailing. You need only write a short letter to the address designated for appeals that is on the decision. Also, the benefits in your claim are not lost for those weeks you are found not eligible, They remain in your claim for future use on weeks when you are available. When you write your appeal letter include a request for reconsideration and give information to show that you are available for other kinds of work. I don't believe there is any quick way to get this decision overturned unless your request for reconsideration is granted and they agree with your statement as to availability. It will take some time to get an appeal hearing so emphasize your willingness to take other work and your need for them to reconsider rather than just sending it up to the appeals board. Good luck.
