So my girlfriend and I have been dating for almost a year and have had sex before she was 18 but I am still a minor. She is pregnant and we are keeping the baby but will she be at risk of prosecution for statutory rape if the doctors or medical staff know I am under age? And do Wisconsin birth certificates ask the fathers birthdate? Would she be in trouble if I put down my real birthdate on it?
If your girlfriend had sexual intercourse with you when you were under the age of 18, she can be charged with a class A misdemeanor if you were at least 16 years old. If you were younger at the time, it would be a felony. If nobody has complained to the police or brought this to the attention of someone who has a duty to report it, your girlfriend will not be charged. I would be reluctant to discuss my date of birth with anyone involved. If you are asked by law enforcement for your name and date of birth, you must respond truthfully. I would NOT recommend giving false information on any official document. You might want to check with hospital staff about what information is required, but I do not believe your date of birth is required.
