My fiance still got 3 years probation in state WA, he want desperatly move to me to germany to make a new start over here with me. Now my Question, is he able to move over here while on probation, and if it would not be legal, what consequeces would it have for him if he would do it anyway, cause in germany they don´t ask for a criminal backround
If your fiance is on probation, he is most likley under a restriction to remain in the State of Washington unless he is given permission by his probation officer or Community Corrections Officer. If he leaves for Germany without the prior approval, a warrant for his arrest based on violation of his probation conditions will most likely be entered. Not knowing what the original charge is, I cannot say whether he could be extradited back to the United States on it. At the least, if he ever came back to the United States, he could be arrested on the warrant.
Usually when someone is on probation and they want to leave the state they must first get permission and the state that they wish to move to must agree to take over supervision. So, the first step is to contact probation for details. Also you should also do some more research on convicted felons (I'm assuming it's a felony based on the length of probation) being allowed to live in Germay. Germany has no visa application requirement for US citizens that are visiting, but their requirements for work visa or residence visas are strict.
