I am one of a number of sales reps in my company, and I am paid by commissions. I was given a document in the beginning of the year that says how much commission I would earn for deals I closed.
Just this week, I was approached by someone from HR who said that I was being put on a "corrective action plan", and that I would be penalized with a reduced commission rate.
I read the document I was provided earlier this year that explains my commission plan, and it doesn't specify that I would receive a reduced commission for being placed on a performance improvement or corrective action plan, and there is no indication that there are different commission rates depending on my performance, it is purely a percentage of gross profit.
Assuming you are an employee at will, the company likely can change the combustion structure for the future but probably not the past.
In a situation like you are in, you should consider finding a new job. Sometimes that is the best way to deal with a bad situation.
I disclaim everything and make no represention of the applicability or accuracy of anything I said here. You are not my client; i am not your attorney. I thought about making this disclaimer as a poem and quickly decided not to do so. Robert Frost can sleep easy.
