My son who has autism was injured in school. Teacher said towards the end of the day he had a meltdown(tantrum). The teacher then put him directly by the wall he hit his head on the wall and sustained injury. Instead of calling for medical attention she just put him on the bus and told the bus attendants, “don’t let him fall asleep”, with no explanation of why not. As he was on his way home he passed out unconscious very quickly. He was taken to the hospital. Tests came back ok. The next day they are threatening to kick him out of school. This all has been distressing for him and us his parents. I believe his civil rights are being violated, child endangerment and negligence are present. Also emotional distress for my child and our family.
You need to speak with a parent education attorney ASAP. They cannot kick him out of school based on the facts you presented. Only where a student classified under the IDEA (has an IEP) causes a very serious injury to someone else can a School District remove him from his IEP placement AND then only for 45 days. Such a fight is not one a Parent can fight without an education attorney assisting them. Should you win, then the Schoolo District will have to pay your costs and reasonable attorney fees.
