I was arrested in a store raid on the 29th and my phone and identification were taken. After my release my phone was still powered on as if my calls were being monitered. I want to know whether or not, it's permitted?
Yes, they won't allow you to bring your phone into central booking. Property is itemized and stored in the facility until you are released. Since you were arrested in a store raid, rather than at your house, they had to do something with your phone, so it was indexed and kept with your property. Unless it was seized as evidence, they do not have the right to use the phone.
