Out of state resident charged with a misdemeanor looking to keep a clean record
Yes, this may be possible under very limited circumstances, depending on the type of charge. Most Judges and prosecutors would rather require a plea before accepting any type of deferral, but you should consult an experienced local attorney to guide you through the process. Your question and then the statement "looking to keep a clean record" raise more questions than can be answered here. The part about a "clean record" suggests that you would be hoping for an expungement after the fact, and that would be hard to do in most "continued for dismissal" deferral situations
This forum offers a "quick answer" to a "quick question" but it is not always the best way to consult counsel. The practice of law usually works best (best results) when the lawyer is able to consult with the client, in private, and make a full assessment of all the facts of the case.
Yes it's technically possible but also unlikely in most instances. You should contact a qualified attorney familiar with the jurisdiction where your charge is pending.
An attorney-client relationship is only created by retaining my legal services. Also, none of my answers to questions on this forum should be considered legal advice.
Without "admitting" guilt? Possibly. You could get a deferred disposition from a trial. However there would be a FINDING of facts sufficient for guilt, and it could not be expunged, so the record would never be "totally clean"
