I had a felony "wobbler". I had it expunged a few years ago. But I think I would be better off with an expunged misdemeanor. Can I get it reduced now? This was in California.
No because once the conviction is dismissed pursuant to 1203.4 the court loses jurisdiction because there is nothing to reduce to a misdemeanor. The case has been dismissed. That is why a PC 17b motion and a 1203.4 motion are usually filed at the same time.
