A student is working on his Masters degree which he will obtain in December. He would like to continue staying in the US to obtain a doctorate, 5 years from now. He needs to obtain a green card and believes that adoption by a US citizen (myself) would achieve that result.
The student is not eligible for status through adoption, as he or she is over the age limit and would not qualify as a “child of a U.S. citizen.” Your friend may have options to apply for a visa to study in the USA and continue with his or her education. It would be beneficial for the student to consult with an attorney and review his or her immigration history, future education options, and determine which path is best for their particular situation and goals.

Adoption only works to obtain immigration benefits if the adoption occurs before the foreign national is 16 years old or less.
