My father is currently pending trial for domestic violence 2nd offense and attempted interference with communication for beating and throwing hot coffee on my step mom. My siblings and I have PPOs on him, but he continues to stalk and harass us. He is out on a PR bond for that offense. New charges were filed against him after he attempted to run me down with his vehicle. It is another domestic violence 2nd offense. My family isn't safe with him out there and we are hoping for him to be in custody soon, and for a long time.
My questions are;
Does the new charge violate his bond?
If convicted of the first offense, will the second be upgraded to 3rd offense?
Yes, a new charge for an alleged crime COMMITTED WHILE on bond, would likely be a violation of the bond. At question is, what is the consequence, if any.
First, second notices are generally set at the time of issuance of the complaint/warrant. The prosecutor could later move to amend the complaint, but in your case, it's not a true third until he has two prior convictions, not two cases charged.
