My daughter is 22yrs old and her father owes over 100,000 in child support. The court order was put in place over 15 yrs ago and he's been to jail for non-payment. I now have his contact information and he lives 10min. away in the same state as she and I.
Is there an order in place and the father has never complied? You could bring a contempt. However, if the father has already been willing to go to jail as opposed to paying, this could be an uphill battle. I highly recommend discussing this in more detail with an attorney.
Best of luck,
It's certainly possible to bring a claim. The laws are very strict and are on your side.
That said: Whether or not it's possible to get paid has quite a bit to do with whether or not he actually has any money. If he has no money then you're unlikely to get $100,000.
Do you want accurate, personalized, legal advice that you can rely on? You will have to hire an attorney, not ask on Avvo Answers. I am not your attorney and am not creating an attorney-client relationship by this post. I am giving only general advice. Any advice may not apply to you or your situation; may not take account of all possibilities, and may not match the advice I would give to a client after a detailed interview. DO NOT rely on this advice or any other advice on Avvo to make your legal decisions.
You should consult with an attorney about filing a contempt complaint. Where the ordet is significant, if he is working, DOR can garnish his wages, lien his tax return, and jail him to collect on the outstanding money owed.
Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals.
