Is it legal to have a background check go back over 35 years?
As long as the information obtained is accurate why would it not be? Most States allow an employer to hire and fire an employee for any reason whatsoever unless they are in a protected class so this should not pose any legal issues. Confirm with local counsel.
Yes, there's no time limit for most companies to conduct their searches.
Please note, my answers to questions do NOT create an attorney/client relationship. Only after a written agreement is entered into between the parties is an attorney/client relationship created. Additionally, the responses posted here are done so on limited information and should not be fully relied upon without an in person consultation where the entire case is reviewed and discussed in detail.
Probably yet. However, if the information provided is incorrect then you might have a claim against the employer.
