Is it legal for the landlord to collect double rent for one month?
Hayward, CA |
We were renting a home for 6 years and decided to move because we recently learned that the landlord's home is in foreclosure. We scheduled a final walk through. The landlord stated that we had an outstanding rent owed to her. It read that for the month of November we owed $1600 plus a $50 late fee and a prorate of 1085 for Nov 1-20th. Is this correct?
Your suspicions are justified. No, she cannot charge you double rent for the month you move out. Assuming you gave 30-days notice, she only owe rent from the first of the month until your move-out date.
