My daughter was raped by my x-boyfriend and he was convicted of the charges. Recently, he tried to have his conviction dismissed. In the commissioners report, that was published to the internet, it listed the exact details of the rape and her full name. Subsequently, she found the information and it lead to severe anxiety and her trying to take her life due to retaliation from her offenders family. She was a minor at the time of the rape but she is now an adult. Can we sue the state for releasing her name?
There is no lawsuit available for this. I suggest your daughter writes a letter to Resident Judge Witham at Kent County Superior Court asking that the decision be withdrawn and re-issued with your daughter's name redacted. As she is now an adult, she should be the person who writes and signs the letter, not you. I agree that her name should not have been included in the decision, but no law was violated by its inclusion.
