Some of the companies I have submitted my application for employment it states they may do a background check and credit check prior to an interview.
No it is not illegal. They do it because bad credit , is a sign of irresponsibility. They believe it would reflect on how responsibly you would do your job etc. Good luck in the job hunt.

However, there still must be a legitimate business reason. That seems to be satisfied. IN very limited circumstances, this could be a disparate impact discriminatory case. However, I am not suggesting it exists here, but it cannot hurt to check with an attorney, and someone who has knowledge on such issues of disparate impact. This would also assume you would be in some protected classification.
