I was out on unprotected leave drawing short term disability after exhausting FMLA. I do have a disability. My employer terminated me without any notice. I was not aware until my catheter company called and said I owed for catheters. I also incurred several large medical bills during the time before I found out my insurance was not active. They never called or wrote me a letter. No exit interview as stated in our employee handbook. Is there anything I can do? Of course there was cobra but I could not afford it.
Unfortunately, if you exhausted FMLA...it will depend if you have any rights under the ADA per your disability. Notice and exit interviews are not legally required...that would be just something the employer wishes to do.
You need to consult with an employment law attorney to see if your disability will give you some protection.
