I know of two people these ages that are dating and having sex but I have been told by some people that it is illegal. I just want to know if it would be something that my local law enforcement would even bother with.
The short answer is it is not illegal. The difference in ages only applies if the younger person is less than 16. However, there may be other issues such as contributing to the delinquency of a minor that the older person could face, particularly, as is often the case with these questions, then the 16 generally doesn't have their parents permission to be in the relationship. Also, there are statutes which make some specific relationships illegal, for example, a teacher and a student.
Some NC law enforcement agencies may still try to charge him with contributing to the delinquency of a minor. I have seen it charged a few times at the request of the 16 year-old's parents when they find out.
