I never trusted my lawyer and soon found out his strategy was to file bogus motions in order to goad the opposing party to settle. If I knew this I never would have hired him. He didn’t even complain about the unconscionably of the opposing party’s actions that led to the dispute. Opposing attorney asked for sanctions on one motion, which led me to ask my lawyer’s strategy!
I spent $125,000 on attorney fees and settled for about that much, I broke even!
Nope, not ethical. Attorney made out if you spent that kind of money.
Attorney Halls response and guidance for next steps is very sound.
NO ATTORNEY CLIENT PRIVILEGE IS...
Strictly speaking, lawyers are not supposed to file any frivolous pleadings or motions. But it happens all the time. There are even attorneys who market this exact brand of “aggressiveness.” If you believe it damaged your case, even through inflated fees, you may contact the State Bar. Unfortunately, attorneys are given wide latitude for professional discretion but sometimes it’s egregious enough to be actionable. You may want to discuss your unhappiness with the attorney directly and if that doesn’t change anything you can use review services to warn others of what you wish you knew. If you do eject to leave reviews, be careful to be truthful or it could constitute defamation which only aggravates this entire situation.
