I am from India and want to implement Indian child support orders in Arizona. The support agency told me that India Is not a signatory to Hague Conv currently. Is that true.If yes than what can I do to get my child support Indian orders to be implemented in USA ,Arizona and how?
First of all, you may simply be better of filing a petition to establish a child support order, an compel compliance with a foreign order. But, do not bring your child to the US, so the court's jurisdiction remains just support. Sue where the father lives and serve him with process asap. Use the Uniform Child Custody Jurisdiction Act as the support for jurisdiction over the child's support. Where Hague does not apply, I believe you just make a case of duty and follow the procedures as closely as possible.
