I filed an Answer to Plaintiff's Complaint in which I denied owing the debt. The Plaintiff filed a motion for summary judgment which was opposed and denied by the court. A few days before scheduled trial, the Plaintiff filed the stipulation of dismissal with prejudice with no cost to either party. I was not contacted prior and did not approve/sign. Case was closed by the court. Am I entitled to reimbursement for court fees and other costs? Case was filed in NJ Special Civil Part.
Yes winner of lawsuit with a side that prevails is entitled to statutory costs and less it is agreed otherwise
The Court fees for Special Civil Part are minimal, so since this case was dismissed with prejudice, it cannot be refiled. You won, be glad and leave it alone. You are the defendant, your permission is not required.
