My injuries in a trip/fall case in NYC are back herniated discs L 3-4 L5S1-prexsting shoulder dislocation and ankle/leg contusions/sprain and vein damage also dental implant injuries. I am considering if the new injuries are rated as serious enough to make a trial feasable in manhatten-/ Low back will likly be pegged as degen/prexsting by carrier however ankle and dental implants are new and would be tough to chgallenge An MRI of Low back 2.5 years before accident shows not damage to the current injuriesif that helps
The unequivocal answer to everything you ask is a definite maybe. Best to let your attorney handle the case. Good luck.

Depends on how persuasive your attorney is and what a jury believes. Expert trial Witnesses will be relied upon to establish what injuries were sustained as a result of the accident and what injuries/medical conditions were pre-existing.
Be sure to be open and honest with your attorney and all witnesses testifying on your behalf.
The only way to know for sure is to have your lawyer collect all of your medical records and speak to your current treating doctors.
