My attorney wants 33.3% if I settle my wrongful termination case but wants 40% if we file a lawsuit and get an award. Is this a normal percentage for the Los Angeles area?

"Normal" depends on many factors. Contingency fees can range higher and lower. If you are being asked to advance costs, or if the attorney does not have substantial experience then the contingency should be lower. If the attorney is advancing all costs and is very experienced, that is well within a range that is appropriate.
