The charge is misdemeanor of first degree for trespassing - failure to leave property upon order. No criminal intent, just came back to a fast food join in a college town to get my phone and the security guard was hell bent on getting me arrested. Such is life, I cooperated with the police after presenting my side of the story, but a previous warning was given. I strongly believe this is not a crime of moral turpitude, right? I have decided to proceed with a pre-trial diversion program by paying a very small fine and doing one work day. I have read that USCIS considers these as convictions. Understandable. But after doing research on U.S.C and the INA I have concluded that though not specified, such a crime is more likely not a CIMT and presents no grounds for inadmissibility, correct?
