I received income verification from the courts and was in the exempt area as I have two dependents. Sheriffs came and levied property inside the building I rent but none of the property is actually mine or purchased by me. Can I offer to settle to avoid further drama.
If none of the property is yours, would it make a difference to you what happened to it? The owner of the property has to file a property claim form which is available from the sheriff. The sheriff then conducts a hearing as to whether the property is owned by the Judgment debtor or by a third-party as you state. If the sheriff determines that it's the third parties property, the sheriff will release the levy.
And you can always offer to settle (but it doesn't mean they will).
