The collection agency calls me and harasses me for the payment. It is his doctor bill not mine. I just received a collection bill in my name for his bill. How can I get them to stop harassing me
At common law, husbands and wives owed duties of support to one another, and therefore a creditor or the state could enforce those duties. In 1939 South Dakota narrowed the common law by codifying in statutory form. South Dakota's neccessaries statute says:
25-2-11. Joint and several liability for necessaries. Every husband and wife shall be jointly and severally liable for the purchase price, if such price be stated or agreed upon at the time of purchase, and if not so stated or agreed upon, for the reasonable value of all the necessaries of life, consisting of food, clothing, and fuel purchased by either husband or wife for their family while they are living together as husband and wife.
It seems facially the statute limits its application to food, clothing and fuel.
However, the South Dakota Supreme Court in the case of Accounts Management, Inc. v Litchfield, the court extended the statute to medical bills. Link here:
