My husband, who just died, had life estate in this property. The house immediately went to his stepkids upon his death. The day after his funeral I received a very nasty letter from their attorney telling me to pack my personal stuff and get out in 7 days. I was caring for my husband for the past several months and had no time to look for a place to live. I am now looking, but I have no money until his estate is settled. These people are refusing to sign papers so it can be settled, which keeps me from being able to get a place. Now they served me with a 15 day notice to vacate. I am making an offer on a place after borrowing from my IRA but I doubt I can be out in the few days I have left on the notice. I don't know what to do. There is no talking to these people. (Bad relations)
You are a legitimate occupant of the property. You cannot be forced out except by a Writ of Possession after a lawsuit is filed and the final judgment is rendered by a judge.
Seek a local attorney who is knowledgeable about probate and real estate to go over your situation. Good luck!
