In order to discipline his son he took the cell phone away which the mom pays for away only until the kid can earn it back. As long as he provides a way they can still communicate or the mother puts a restriction on the phone where he can only contact the mother and father on the phone can he legally take it? Child is 17
Yes, a parent can discipline a child so long as the child is not harmed or the discipline violates a court order. And because a cell phone is probably the most effective way to discipline a 17 year old, it's probably going to be relatively effective. Of course, the mother can totally undermine the lesson by not backing dad and saying "sorry son, you need to obey dad's rules at dad's house" - and thereby teach the child to respect neither his father or authority generally. But then everybody loses. So unless the court ordered the child to be allowed to always maintain contact with mom through this cell phone, dad's probably in the right.
