On my very first visit to p.o, I told the probation intake officer (only because they wanted a urine test) that i might be dirty. They say "no problem, its your first time". After a couple of good, normal visits with p.o and a clean u.a, a month goes by and she tells me over the phone that shes violating me for the incident upon intake. Nothing filed, no hearing. But its on record that i plead guilty to it. Totally illegal?
There’s nothing illegal about what your PO has done. You will have an opportunity to present your side to the judge.
PLEASE DO NOT PRIVATE MESSAGE ME with followup questions. Instead, you may make a comment below, which will be sent to me automatically. If you need an attorney to assist you, please search in your local area, or click the "Find a Lawyer" link at the top of the page. I am active on AVVO and answer questions only as a public service. I am an Attorney-at-Law, licensed to practice law only in the state of Iowa. Unless we have both signed a formal retainer agreement you are not my client, and my discussion of issues does not constitute legal advice.
If your PO files it as a report of violation and requests a hearing, then you will be able to contest the violation. An attorney would help.
