I would like to know this in Georgia please.
Usually, money in bank accounts can be exempted under the wildcard exemption, so the trustee cannot take them. However, whether you can take the exemption will depend on several factors, so you should really at least consult with a bankruptcy attorney before you file. There are things that can be done prior to filing bankruptcy to offset issues such as this, but once you file, all property is subject to being taken if not properly exempted.
The above information is general in nature. In order to obtain more specific legal advice upon which to base your important decisions, you should consult with an attorney in person and retain one of your choosing. Robert M. Gardner, Jr. Gardner Law Firm
