When you hired him the company was in bankruptcy? Were you working there then? It appears you were. Being in bankruptcy does not shield a company from a claim, but it certainly makes the viability of it much more difficult. This is a discussion you should have with your attorney. His failure to tell you does not change the difficulty of the claim or the ability to collect anything, all that remains the same and would have been the same in 2009.
