Got an MIP in Missouri when I was 19 and got it taken down to SIS. I am 21 now, didn't get into any more trouble so it should be expunged... I think. Nervous that they will still be able to see this? Also, credit isn't great... have lots of hospital bills. Worried they will rescind my offer because of my credit score. Seems unlawful/like this should be illegal. This job is for an eight week internship. The internship is in Marketing... won't be handling money. Need to know likelihood that MIP will show and my rights regarding if I am denied the offer I already accepted because of implications in credit report. Need to know if I have any recourse. I go to college in MO, am from IL, and received an offer in CA if that makes a difference.
First off none your your many questions are about juvenile law as people are adults as far as the criminal law is concerned at 17 in Missouri.. I have changed it to a criminal defense. The SIS should be a closed record. However there are exceptions such that some people can see closed records such as the government and such.
As for the legal issues of the offer of internship and such I suggest you re-ask those questions with an employment or education practice area. It might help to as the California related questions with California as they location as the location helps determine which attorneys see your question.

The likelihood that the MIP will show is very low but Mr. Hardin indicated there are exceptions.

If you completed an SIS probation it does not get expunged. Instead, it becomes a closed record to the public. However, some people can still see it depending on when a private background check gets done because the disposition will show up on casenet until probation is completed. A lot of private companies now purchase that information and then sell it to employers when they want a background check done. I do not agree with this practice, but unfortunately it is happening.
As long as you do not lie on an application for employment, that is usually the red flag that potential employers look for. If you pled guilty to MIP and completed your SIS successfully, please note that you have not been "convicted" of MIP. Instead, you pled guilty. If the application asks about convictions, say no. If it asks whether you pled guilty, then you did. Regardless, be prepared to answer the questions if it comes up. Something like "it was a one time thing when I was out with my friends"...."poor judgment never happened again"...etc. Just be ready if it comes up so you are not caught off guard.
