I am a DACA recipient and recently filed for a marriage based green card using forms i-485 and i-130. The i-130 has been approved and the i-485 is currently pending. However my DACA is expiring within a month and I am trying to renew it on my own. On form i-765, box 27 asks for my eligibility category. Can I submit under the category of (c9) along with my i-797c receipt, therefore waiving the $495.00 fee due to my pending i-485 as well as submitting the i-821d on top of that at no additional fee, or should I list myself as (c33) (a DACA recipient) and pay the 495 fee? I am very tight on money and trying to do this with the least expensive method.
DACA renewal would enter c33. A person with a pending I-485 may file an I-765 as c9. C9 not daca, but better.
