After working for this company for almost a year and a half i was terminated for taking a too long of lunch break. But the thing is, this is how i was trained by all the veteran drivers that have been there 10+ years. None of them could understand how they did that?? Then after being terminated i was harassed and threatened by the supervisor, via text msgs. I was also sent a msg that was seen by my wife and has caused enough problems that i was put out my household by her.. Is there anything i can do about this? I am now collecting unemployment ,which isn't a lot of course, which is why i am looking for a free consultation. I would like to be compensated by the company for being unfairly terminated as well as the aggravation, mental suffering at the hands of there supervisor. I have been in contact with this company numerous times and reported this to no avail... Thank you for your responses.... Mr. James Randolph III
Feel free to use the Avvo "Find a Lawyer" function. This Q&A is not intended for attorney recruitment (or client solicitation either).
This answer is offered as a public service for general information only and may not be relied upon as legal advice.
If an employee is being treated differently than other employees in matters of discipline, and the employee is in a different protected class (such as race, sex, national origin, religion, age 40 or over, disability) or in retaliation for raising certain protected complaints, than the employee may have a discrimination claim. Certain types of threats from a former employee could violate the law against blacklisting former employees or could be violent threats that should be referred to the police. You can use Avvo to find an experienced Virginia employment attorney for a free consult, I believe free consults are listed in attorney profiles, or you could contact the Virginia Bar Association legal referral service.
Please be aware that my answer discusses the law only generally and is not legal advice, nor does it create an attorney client relationship. You should not rely on answers in this Q&A without consulting an attorney authorized to practice law in your state to review the specific issues in your case. Keep in mind attorneys are not permitted by Avvo to ask for business here and our answers reflect that, but you may contact an attorney through their profile for a consultation. Thank you.
