is proposing community service but its still s charge on my record. I can't have this on my record. Please help . what is the benefit of a divergent program?
Most diversion programs result in the charge being dismissed. The goal is to get the charge off your record. Speak to your public defender again and share your concerns. Or consult privately with an attorney in Florida. This could be a good way for you to avoid any kind of permanent mark. Good luck.

If you have no criminal history, a diversion program may be available depending on the county and the policies of that particular state attorney's office. Diversion is often the best way to keep your record clean and increase your chances of expunction later, but beware that you may still have some explaining to do to your employer even if you avoid criminal convictions. Educational institutions tend to be very strict with employees since you're handling young children. Be careful what you say while the criminal case is still pending, statements to anyone can potentially be used against you.
The advantage is they drop the case. The disadvantage is that it's a hassle, there are costs and getting your record sealed may not help you if you work at a school.
