Marijuana becomes legal on Jan 1 2020 my current employer is saying that hospital rules override state law. Is this true ? The Illinois smoker act states that an employer can no longer take action against a person that test positive for THC. My job is non clinical and doesn't involve any sort of licensing,
The law allows employers to conduct drug tests. Whether that conflicts with the Right to Privacy in the Workplace Act or not is yet to be seen.
